By booking services with Elite Gender Reveal LLC, submitting payment, signing a proposal or agreement, or electronically accepting these terms, the Client acknowledges that they have read, understood, and agreed to the following Terms and Conditions.
1. Booking and Payment
The Client agrees to pay Elite Gender Reveal LLC the total amount stated in the approved proposal, invoice, or service agreement.
A reservation payment or retainer may be required to secure the event date. The event date is not considered reserved until the required payment has been received and written confirmation has been issued by Elite Gender Reveal LLC.
Unless otherwise stated in writing, the remaining balance must be paid in full no later than seven calendar days before the event. Elite Gender Reveal LLC is not required to provide services when a balance remains unpaid.
Late payments may be subject to a late fee stated on the invoice or agreement. Payments received may first be applied to outstanding fees, damages, additional labor, overtime, travel charges, or other amounts owed.
Any requested additions, upgrades, extended service time, additional equipment, design changes, travel adjustments, or last-minute services may result in additional charges.
2. Reservation Retainer
The reservation retainer compensates Elite Gender Reveal LLC for reserving the event date, declining other bookings, beginning administrative work, coordinating staff, and preparing equipment or materials.
Unless otherwise required by applicable law or specifically stated in writing, the reservation retainer is non-refundable.
At the sole discretion of Elite Gender Reveal LLC, an eligible reservation payment may be transferred one time as a credit toward another available service occurring within twelve months of the original event date. Credits are not guaranteed, have no cash value, cannot be transferred to another person, and remain subject to availability, pricing changes, and any additional balance due.
3. Client Cancellation
All cancellation requests must be submitted in writing.
Unless a separate signed agreement states otherwise:
The reservation retainer is non-refundable.
Payments made for custom, personalized, rented, purchased, ordered, prepared, or specially sourced items are non-refundable.
Cancellations made within seven calendar days of the event may require payment of the full remaining balance because staff, transportation, materials, and equipment have already been committed.
Failure to provide access to the venue, necessary permissions, accurate event information, or a safe setup area may be treated as a Client cancellation.
No refund will be issued for unused portions of a package after services have begun.
4. Rescheduling
Requests to change the event date are subject to availability and must be made in writing.
A rescheduling fee may apply. Any previously paid amount approved as a credit will be applied to the rescheduled event, but the Client remains responsible for pricing increases, additional travel, replacement materials, staffing changes, permits, or other added costs.
If Elite Gender Reveal LLC is unavailable on the requested replacement date, the matter will be treated according to the cancellation terms unless otherwise agreed in writing.
5. Weather and Outdoor Events
The Client understands that outdoor events are affected by weather, including rain, wind, extreme heat, cold, lightning, wet ground, and unsafe surface conditions.
The Client is responsible for providing a suitable backup location or weather plan. A backup location must have sufficient space, ceiling height, access, ventilation, electrical capacity, and permission for the selected equipment.
Elite Gender Reveal LLC may delay, modify, relocate, substitute, limit, or discontinue any service when weather or site conditions create a safety risk or may damage equipment. Safety decisions made by Elite Gender Reveal LLC personnel are final.
Weather conditions do not automatically qualify the Client for a refund when Elite Gender Reveal LLC is ready and able to perform, travel has occurred, staff and equipment have been committed, or an appropriate alternative can be provided.
6. Force Majeure and Circumstances Beyond Control
Elite Gender Reveal LLC will not be responsible for delay, interruption, modification, or inability to perform caused by circumstances beyond its reasonable control, including severe weather, natural disasters, fire, flood, government restrictions, road closures, traffic emergencies, venue closure, utility failure, equipment transportation incidents, civil disturbance, labor shortages, illness, public-health emergencies, or acts of God.
When reasonably possible, Elite Gender Reveal LLC may offer rescheduling, service substitution, or credit. Any remedy will be determined based on costs already incurred and the specific circumstances.
7. Venue Access and Setup Requirements
The Client must provide accurate event information, including the event address, start time, reveal time, contact person, parking instructions, access restrictions, stairs, elevators, surface conditions, and venue rules.
The Client is responsible for ensuring that Elite Gender Reveal LLC has:
Timely and unobstructed access for setup and breakdown.
Safe and legal loading and parking access.
Adequate setup space and clearance.
Required electrical service, when applicable.
A clean and reasonably level setup surface.
Permission from the property owner or venue.
Privacy when necessary to prepare the reveal confidentially.
Delays caused by the Client, venue, guests, vendors, parking restrictions, blocked access, or incomplete site preparation may shorten the service period and may result in overtime or waiting fees.
8. Permits, Venue Rules and Approvals
The Client is responsible for obtaining all permissions, permits, approvals, and venue authorizations required for the event and selected services unless Elite Gender Reveal LLC expressly agrees in writing to obtain them.
The Client must disclose all venue restrictions relating to balloons, smoke, fog, confetti, powder, compressed gas, sound, electricity, aircraft, fire alarms, open flames, cleanup, or outdoor equipment.
Elite Gender Reveal LLC is not responsible when a service must be changed, reduced, relocated, or cancelled because the Client did not obtain required permission or failed to disclose applicable restrictions.
9. Safety and Instructions
The Client and all participants must follow the instructions of Elite Gender Reveal LLC personnel.
Only authorized staff may operate professional equipment. Guests may not touch, move, activate, climb on, disconnect, alter, or interfere with equipment, wiring, machines, cannons, tanks, inflatables, props, backdrops, or safety barriers.
Elite Gender Reveal LLC may stop or refuse a service when a person is intoxicated, acting recklessly, ignoring instructions, entering a restricted area, damaging equipment, or creating an unsafe condition.
Children must remain supervised by a responsible adult at all times.
10. Inflatables and Bubble-Dome Experiences
Inflatable equipment requires a clear, safe, properly sized setup area and continuous access to suitable electrical power.
Participants acknowledge that inflatable floors are flexible, bouncy, and not completely steady. Participants must follow all entry, footwear, capacity, age, weight, and safety instructions provided by the attendant.
The Client must ensure that no sharp objects, food, drinks, shoes, jewelry, pets, unauthorized equipment, or unsafe items enter the inflatable.
11. Smoke, Fog, Dry Ice, Powder and Special Effects
Certain reveal services may produce smoke, fog, vapor, residue, powder, confetti, noise, or temporary reduced visibility.
Smoke, fog, and dry-ice effects may activate smoke detectors or alarm systems and are generally better suited for outdoor or approved open spaces. The Client is responsible for obtaining venue approval and notifying the venue or alarm-system manager in advance.
Elite Gender Reveal LLC does not guarantee that residue, powder, confetti, or color products will not temporarily mark grass, clothing, shoes, furniture, pavement, walls, or other surfaces.
The Client accepts the ordinary and disclosed risks associated with the selected effect and agrees to ensure that guests remain at the instructed distance.
12. Confidential Handling of Gender Results
Elite Gender Reveal LLC will make reasonable efforts to keep the gender results confidential before the reveal.
The Client is responsible for ensuring that the information provided is accurate, legible, complete, and clearly identifies the intended reveal color.
Elite Gender Reveal LLC is not responsible for incorrect information supplied by a medical provider, laboratory, family member, friend, envelope holder, third party, or Client representative.
The Client should not send confidential medical records beyond the information reasonably necessary to prepare the reveal.
13. Design, Colors and Substitutions
Photographs, mockups, inspiration images, digital renderings, and previous event images are examples of style and general appearance. Exact duplication is not guaranteed.
Colors may appear different because of lighting, weather, photography, screen settings, material availability, balloon production, dye lots, flower seasonality, and surrounding décor.
Elite Gender Reveal LLC may make reasonable substitutions when a material, flower, balloon color, prop, or product becomes unavailable, unsafe, discontinued, delayed, or unsuitable. Substitutions will be made as closely as reasonably possible to the agreed design and value.
14. Equipment, Rentals and Property Damage
All rented equipment and décor remain the property of Elite Gender Reveal LLC.
The Client is responsible for loss, theft, excessive cleaning, misuse, unauthorized movement, or damage caused by the Client, guests, children, pets, venue personnel, or other vendors.
Repair or replacement charges may be billed after the event and are due upon receipt.
The Client may not remove, retain, relocate, lend, modify, or dispose of any rental item without written authorization.
15. Cleanup and Confetti
Standard breakdown and cleanup apply only to items and equipment supplied by Elite Gender Reveal LLC unless otherwise stated.
Venue-required cleaning, extensive confetti removal, trash removal, damage remediation, cleaning caused by guests or other vendors, and cleanup outside the agreed service area may result in additional fees.
The Client remains responsible for confirming whether the venue permits confetti, balloons, powder, fog, or similar materials.
16. Event Timing and Delays
The Client must be ready to proceed at the agreed reveal time.
Delays caused by the Client, guests, venue, photographer, videographer, planner, DJ, catering staff, or another vendor do not extend the contracted service period unless Elite Gender Reveal LLC agrees and applicable overtime charges are paid.
Elite Gender Reveal LLC is not responsible for missed moments, shortened service, or reduced photography coverage caused by delays outside its control.
17. Photography and Video Services
Photography or video services are included only when specifically listed in the Client’s proposal or invoice.
The Client understands that coverage depends on event conditions, guest cooperation, lighting, weather, venue restrictions, timing, and visibility. Elite Gender Reveal LLC does not guarantee that every person, reaction, detail, or moment will be captured.
Creative selection, composition, color treatment, cropping, retouching, and editing remain within the professional judgment of the photographer or videographer.
18. Photography Editing and Requested Changes
Edited images will generally be delivered within three weeks after the event and after full payment has been received. This is an estimated delivery period, not a guaranteed deadline. If additional editing time is reasonably required, the Client will be notified.
The Client receives the photographer’s final artistic selection and editing. Requests for additional retouching, extensive revisions, object removal, body alterations, background replacement, or re-editing may require an additional fee.
The Client may crop or resize delivered photographs for ordinary personal posting but should not apply filters or edits that materially misrepresent the photographer’s work while identifying Elite Gender Reveal LLC or its photographer as the creator.
Unedited or RAW files are not included. When available, RAW files may be offered for an additional fee and under separate licensing terms.
19. Photo and Video Delivery
Edited photographs or videos may be delivered through an online gallery or download link that remains active for 30 days.
The Client is responsible for downloading and securely backing up all files before the gallery or link expires.
Elite Gender Reveal LLC does not guarantee permanent storage and is not responsible for files lost after expiration, deletion, device failure, account loss, or the Client’s failure to download and back up the files.
Reactivation, file retrieval, replacement galleries, or archival recovery may be unavailable or subject to an additional fee.
20. Copyright and Personal-Use License
Unless copyright is transferred through a separate written agreement, the photographer or copyright owner retains copyright in the photographs and videos. The U.S. Copyright Office explains that a photographer ordinarily owns the copyright, even when hired for an event, unless ownership is transferred in a signed writing.
Upon full payment, the Client receives a non-exclusive license to download, display, print, and share the delivered images for personal, non-commercial purposes.
The Client may not sell, sublicense, submit for commercial publication, use in paid advertising, provide to another business for promotional use, remove watermarks, or commercially exploit the images without written permission.
Vendors wishing to use the images for advertising or portfolio purposes must obtain permission from Elite Gender Reveal LLC or the applicable photographer.
21. Promotional and Social-Media Use
Unless the Client opts out in writing before the event, the Client grants Elite Gender Reveal LLC permission to photograph and record the event and to use selected images or footage for its website, social media, portfolio, advertising, printed materials, award submissions, and other promotional purposes.
Elite Gender Reveal LLC will not intentionally publish confidential medical documents or information revealing the result before the reveal.
A Client who does not wish to authorize promotional use must provide written notice before the event. An opt-out does not prevent incidental photography of décor or equipment when identifying guests can reasonably be excluded.
22. Guest and Minor Consent
The Client is responsible for informing guests that photography and video recording may occur.
The Client represents that they are authorized to provide consent for their minor children appearing in event photographs or videos. For other minors, the Client should obtain permission from their parent or legal guardian before requesting that the minor participate in featured photographs or promotional content.
23. Third-Party Vendors
Elite Gender Reveal LLC is not responsible for the acts, omissions, delays, workmanship, equipment, or services of venues, photographers, videographers, DJs, planners, caterers, balloon installers, aircraft operators, musicians, transportation providers, or other independent vendors unless that vendor is directly contracted and controlled by Elite Gender Reveal LLC.
Coordination with another vendor does not create responsibility for that vendor’s performance.
24. Limitation of Liability
To the maximum extent permitted by law, Elite Gender Reveal LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, including emotional distress, lost opportunity, lost profits, loss of enjoyment, or reputational harm.
To the maximum extent permitted by law, the total liability of Elite Gender Reveal LLC arising from a booking will not exceed the amount actually paid by the Client for the specific service giving rise to the claim.
Nothing in these terms is intended to exclude liability that cannot legally be excluded, including liability resulting from gross negligence, willful misconduct, or another non-waivable obligation.
25. Client Responsibility and Indemnification
The Client is responsible for the conduct of guests, invitees, children, pets, venue personnel, and vendors under the Client’s direction.
To the extent permitted by law, the Client agrees to defend and indemnify Elite Gender Reveal LLC from third-party claims arising from the Client’s breach of these terms, unauthorized use of the venue, failure to obtain permission, violation of safety instructions, guest misconduct, or damage caused by persons under the Client’s control.
26. Termination or Refusal of Service
Elite Gender Reveal LLC may terminate or suspend services when:
The Client has not paid as agreed.
The Client provides false or incomplete information.
The venue or setup is unsafe or unlawful.
Guests interfere with equipment or staff.
The Client or a guest engages in threatening, abusive, discriminatory, harassing, or dangerous behavior.
Required permission, access, power, space, or safety conditions are unavailable.
When termination results from the Client’s breach, payments already made are non-refundable to the extent permitted by law, and the Client remains responsible for services performed, materials purchased, labor committed, damages, and applicable cancellation charges.
27. Complaints and Notice of Claims
Any concern regarding services should be reported in writing as soon as reasonably possible so Elite Gender Reveal LLC has an opportunity to investigate and address it.
Claims involving visible damage, missing rentals, delivery concerns, or service performance should be reported within seven calendar days after the event. This reporting period does not eliminate any legal rights that cannot be waived.
28. Governing Law and Venue
Unless a separate signed agreement provides otherwise, these Terms and Conditions will be governed by the laws of the state where Elite Gender Reveal LLC maintains its principal business office, without regard to conflict-of-law principles.
Any legal proceeding shall be brought in a court of competent jurisdiction located in that state or county, except where applicable consumer law requires otherwise.
Because your events may occur in New York, New Jersey, or Connecticut, an attorney should confirm the correct governing-law and dispute-language for your business location and booking process.
29. Severability
If any provision of these Terms and Conditions is found invalid or unenforceable, the remaining provisions will continue in effect. The invalid provision will be limited or modified only to the extent necessary to make it enforceable where legally permitted.
30. Entire Agreement and Changes
The approved proposal, invoice, service agreement, and these Terms and Conditions constitute the entire agreement between the parties and replace prior verbal discussions, text messages, emails, or representations concerning the booking.
Any change must be confirmed in writing by Elite Gender Reveal LLC. Client requests are not accepted merely because they were discussed verbally or sent by message.
31. Electronic Acceptance
The Client’s electronic signature, checkbox acceptance, online booking, written approval, or payment may serve as acceptance of these Terms and Conditions.
